The Commodity Futures Trading Commission has announced it is taking legal action against the state of Wisconsin, filing a lawsuit that challenges the state’s involvement in sports betting regulation as it relates to major prediction markets. The federal agency stated that it is suing to “reaffirm its exclusive jurisdiction” over certain financial instruments that it argues fall under its regulatory purview, not state gambling laws.
The dispute centers on prediction markets—platforms where users can place bets on the outcomes of sporting events, elections, and other real-world occurrences. The CFTC contends that these markets constitute derivatives or futures contracts, which are subject to federal oversight under the Commodity Exchange Act.
